A motion for new trial is a procedure that allows the trial court to order a new trial to correct significant errors in the previous trial that prevented a party from receiving a fair trial.
In Idaho, a motion for a new trial is governed by the Idaho Rules of Civil Procedure, specifically Rule 59. A party may file a motion for a new trial within 14 days after the entry of judgment, or within another time set by the court. Grounds for a new trial include errors of law made by the court during the trial, juror misconduct, newly discovered evidence that could not have been obtained with reasonable diligence before or during the trial, prejudicial misconduct by an attorney or party, among others. The purpose of the motion is to address issues that may have significantly affected the outcome of the trial, thereby preventing a fair trial. If the court finds that such errors or issues did indeed prevent a fair trial, it may grant a new trial. The decision to grant a new trial is at the discretion of the trial court, and such decisions are subject to limited review by appellate courts.
