Although there is no federal (nationwide) law that prohibits texting or using a wireless phone while driving, many states have passed laws that prohibit such activities—and some municipalities (cities, towns) have also passed ordinances that restrict texting, talking, or emailing while driving. For example:
• 25 states, the District of Columbia, Puerto Rico, U.S. Virgin Islands, and Guam have banned drivers from hand-held phone use while driving.
• 48 states, the District of Columbia, Puerto Rico, U.S. Virgin Islands, and Guam have banned texting while driving for all drivers.
• 37 states and the District of Columbia prohibit all cell phone use by novice drivers.
• 23 states and the District of Columbia prohibit school bus drivers from cell phone use while driving.

In West Virginia (WV), it is illegal to text or use a handheld mobile device while driving. The state has specific laws that address distracted driving, particularly focusing on the use of cell phones. West Virginia prohibits all drivers from texting while driving, which includes reading, writing, or sending text messages and emails. Additionally, the state bans the use of handheld cell phones for all drivers. Novice drivers, which typically include learners and intermediate license holders under the age of 18, are not allowed to use cell phones at all while driving, whether handheld or hands-free. School bus drivers in West Virginia are also prohibited from using cell phones when driving, to ensure the safety of child passengers. These regulations are in place to reduce distractions and enhance road safety. Violations of these laws can result in fines and points on the driver's license. For the most current information and specifics regarding the penalties and scope of these laws, individuals should refer to the West Virginia Code or consult with an attorney.
