Although there is no federal (nationwide) law that prohibits texting or using a wireless phone while driving, many states have passed laws that prohibit such activities—and some municipalities (cities, towns) have also passed ordinances that restrict texting, talking, or emailing while driving. For example:

• 25 states, the District of Columbia, Puerto Rico, U.S. Virgin Islands, and Guam have banned drivers from hand-held phone use while driving.

• 48 states, the District of Columbia, Puerto Rico, U.S. Virgin Islands, and Guam have banned texting while driving for all drivers.

• 37 states and the District of Columbia prohibit all cell phone use by novice drivers.

• 23 states and the District of Columbia prohibit school bus drivers from cell phone use while driving.

In California, both texting and hand-held cell phone use while driving are illegal for all drivers, as per the California Vehicle Code. The state has implemented these laws to reduce distractions and enhance road safety. Specifically, California Vehicle Code Section 23123.5 prohibits writing, sending, or reading text-based communications while driving, which includes texting, emailing, and other forms of messaging. Additionally, Section 23123 prohibits drivers from using a handheld wireless telephone while operating a motor vehicle. Exceptions to these prohibitions include situations where the driver is using a hands-free device or is making an emergency call to a law enforcement agency, a medical provider, the fire department, or other emergency services. California also has stricter laws for novice drivers and school bus drivers. Under California Vehicle Code Section 23124, drivers under the age of 18 are prohibited from using a wireless telephone, even with a hands-free device, while driving. Furthermore, school bus drivers are also banned from using cell phones while driving, whether the bus is in motion or stopped to load or unload students, as per Section 23125 of the California Vehicle Code.
