Bigamy is the act of marrying one person while being legally married to another. Polygamy is the practice or custom (often religious) of having more than one wife or husband at a time. Most states prohibit a party from having more than one marriage license at a time, and in most states bigamy is a crime.
In Indiana, as in most states, bigamy is illegal. Under Indiana law, a person who is already legally married and goes on to marry another person commits the crime of bigamy, which is a Level 6 felony. This applies regardless of whether the second marriage occurs in Indiana or another jurisdiction. Polygamy, the practice of having more than one spouse at the same time, is also not recognized or permitted under Indiana law. The state only recognizes marriage between two individuals, and any additional marriage licenses will not be issued to individuals who are already married. It's important for individuals to dissolve their first marriage legally through divorce or annulment before entering into another marriage to avoid legal penalties associated with bigamy.
