A firearm is generally a rifle, pistol, shotgun, or other portable weapon that expels a projectile (bullet) by use of an explosive action. The definition of a firearm may vary from state to state under state statutes—and under federal statutes—and related items such as a muffler or silencer may be included in the definition of a firearm for purposes of certain criminal offenses (crimes).
In New York State, a firearm is defined under Penal Law Section 265.00 as any pistol or revolver, a shotgun having one or more barrels less than eighteen inches in length, a rifle having one or more barrels less than sixteen inches in length, any weapon made from a shotgun or rifle if such weapon as modified has an overall length of less than twenty-six inches, or an assault weapon. Additionally, the term 'firearm' also includes any firearm silencer. New York has strict gun control laws and requires individuals to obtain a license to legally possess a handgun. The state does not honor firearm licenses or permits from other states. Federal law also has its own definition of a firearm, which includes any weapon that expels a projectile by the action of an explosive, the frame or receiver of such a weapon, any firearm muffler or silencer, or any destructive device. Federal law regulates the manufacture, sale, and possession of firearms and ammunition and imposes background checks and certain restrictions on who may own a firearm.
