A firearm is generally a rifle, pistol, shotgun, or other portable weapon that expels a projectile (bullet) by use of an explosive action. The definition of a firearm may vary from state to state under state statutes—and under federal statutes—and related items such as a muffler or silencer may be included in the definition of a firearm for purposes of certain criminal offenses (crimes).
In Maine, a firearm is defined under state law as any weapon, whether loaded or unloaded, that is designed to expel a projectile by the action of an explosive. This includes rifles, shotguns, and pistols. Maine's definition generally aligns with the federal definition found in the Gun Control Act of 1968, which also includes any weapon which will or is designed to or may readily be converted to expel a projectile by the action of an explosive. Additionally, under both Maine and federal law, items such as silencers (also known as suppressors) are considered firearms and are subject to regulation. Maine does not require a permit to purchase firearms and allows open carry without a permit, but concealed carry requires a permit. It is important to note that federal law also regulates firearms and includes background checks and other restrictions that apply in Maine as well as all other states.
