age discrimination (ADEA)

The Age Discrimination in Employment Act (ADEA) is a federal statute that prohibits employment discrimination against persons 40 years of age or older. The ADEA is located in the United States Code, beginning at 29 U.S.C. §621.

In Montana, as in all states, the Age Discrimination in Employment Act (ADEA) applies, providing protection for employees and job applicants who are 40 years of age or older from discrimination on the basis of age in hiring, promotion, discharge, compensation, or terms, conditions, or privileges of employment. The ADEA is enforced by the Equal Employment Opportunity Commission (EEOC). Montana also has its own state laws that may provide additional protections against age discrimination. Employers in Montana must comply with both federal and state laws regarding age discrimination. It's important for employees and employers to understand that the ADEA sets the minimum standards for protection against age discrimination, and state laws may enhance these protections or provide additional remedies.
