All states have laws against boating under the influence (BUI), which make it a crime to operate a boat or watercraft on a public waterway while under the influence of alcohol or drugs.
In Nebraska, operating a boat or watercraft under the influence of alcohol or drugs is illegal and is considered Boating Under the Influence (BUI). According to Nebraska Revised Statute 37-1258.02, a person is prohibited from operating or being in actual physical control of any motorboat or vessel, or manipulating any water skis, surfboard, or similar device on the waters of the state while under the influence of alcohol or drugs. The legal blood alcohol content (BAC) limit for operating a boat in Nebraska is 0.08%, the same as for operating a motor vehicle. Penalties for BUI can include fines, imprisonment, and the suspension or revocation of boating privileges. The state may also require completion of a boating safety course. Enforcement is carried out by the Nebraska Game and Parks Commission and other law enforcement agencies.
