Bigamy is the act of marrying one person while being legally married to another. Polygamy is the practice or custom (often religious) of having more than one wife or husband at a time. Most states prohibit a party from having more than one marriage license at a time, and in most states bigamy is a crime.
In Hawaii, bigamy is prohibited under state law. According to Section 572-1 of the Hawaii Revised Statutes, it is illegal for any person who has a living husband or wife to marry another person, except in cases where the existing marriage is void, the spouse has been absent for five successive years without being known to be alive, or the spouse is generally considered to be dead. Bigamy is classified as a felony offense in Hawaii. As for polygamy, it is not legally recognized or permitted in Hawaii, and the state's marriage laws require that a marriage must be between two persons only. Therefore, any attempt to enter into a polygamous marriage would be subject to the same legal prohibitions and penalties as bigamy.
