A lien release (also known as a release of lien, lien cancellation, or cancellation of lien) is the document filed in the county records to release or discharge a mechanic’s and materialmen’s lien (also known as a construction lien or contractor lien) that was filed as a claim on the property title to secure payment for labor and materials provided to improve the real estate.
In Virginia, a lien release is a legal document that removes a previously filed mechanic's lien from the property records. A mechanic's lien is a security interest that can be placed on a property title by contractors, subcontractors, or suppliers who have not been paid for labor or materials used in improving the property. Once the debt is paid, the lienholder is required to release the lien. In Virginia, the lienholder must provide a certificate of release to the property owner within 40 days of satisfaction of the lien. The property owner can then file this certificate with the clerk of the circuit court in the county where the property is located to remove the lien from the public record. If the lienholder fails to provide the release, the property owner may petition the court to release the lien, and the lienholder may be liable for any damages caused by the failure to release the lien in a timely manner.
