In Montana, as in all states, bankruptcy is a federal matter overseen by the U.S. Bankruptcy Courts, which are specialized courts within the federal judiciary system. These courts handle all bankruptcy cases under the federal law outlined in Title 11 of the United States Code, also known as the Bankruptcy Code. The state of Montana is served by the United States Bankruptcy Court for the District of Montana. While bankruptcy courts are federal courts, state laws and exemptions also play a significant role in bankruptcy cases, particularly in determining property exemptions and the eligibility for filing Chapter 7 or Chapter 13 bankruptcy. However, any legal proceedings related to bankruptcy are initiated and resolved in the federal bankruptcy court system.
