§ 623. Racing dates
The Racing Commission shall be responsible for all racing dates but shall not assign dates for race meets at which pari-mutuel wagering is conducted at the same time as an agricultural fair at which horse racing was conducted during at least three years of the last 10 years immediately before the passage of No. 259 of the Acts of 1959 if the agricultural fair is located within 50 miles of the race track at which pari-mutuel racing is to be conducted, unless the Commission finds there is no conflict between that race track and the agricultural fair.
