Section 106 - Transportation network driver drug or alcohol use policy.

(1) A transportation network company shall implement a policy that: (a) provides that a transportation network driver may not use a drug or alcohol or be under the influence of a drug or alcohol while providing transportation network services; (b) is posted on the transportation network company's website or software application; and (c) provides procedures for a passenger to report to the transportation network company a transportation network driver who the passenger suspects violated the policy.

(2) If a transportation network company receives a complaint about a transportation network driver under Subsection (1)(c), the transportation network company shall: (a) suspend the transportation network company driver; and (b) conduct an investigation into the transportation network company driver and the conduct alleged in the complaint.

(3) A transportation network company shall maintain records related to a complaint or investigation under this section for a minimum of two years after the day on which the transportation network company receives the complaint.
