16-19-70.1. Costs and expenses of disciplinary proceedings. (a) State Bar of South Dakota. Costs and expenses incurred by the board in the investigation or prosecution of any disciplinary or reinstatement proceeding under this chapter shall be paid by the State Bar, provided, however, that the expenses of a disciplinary proceeding may, in the discretion of the Supreme Court, be assessed against the attorney who is the subject of such proceeding.
(b) Attorney General. The attorney general shall pay the costs and expenses the attorney general's office incurs in the investigation or prosecution of any disciplinary proceeding under this chapter.
(c) Unified Judicial System. The Unified Judicial System shall pay the costs and expenses incurred by the referee, the court reporter, and witnesses when a disciplinary action is referred to a referee under § 16-19-67.
