Section 42-72.11-1 Definitions.

§ 42-72.11-1. Definitions. As used in this chapter, the following words, unless the context clearly requires otherwise, shall have the following meanings:

(1) "Administrative penalty" means a monetary penalty not to exceed the civil penalty specified by statute or, where not specified by statute, an amount not to exceed five hundred dollars ($500).

(2) "Citation" means a notice of an assessment of an administrative penalty issued by the director or his or her duly authorized agent.

(3) "Department" means the department of human services.

(4) "Director" means the director of the department of human services or his or her duly authorized agent.

(5) "Person" means any public or private corporation, individual, partnership, association, or other entity that is licensed as a child day care center, family child day care home, group family child day care home or any officer, employee or agent thereof.
