§ 42-63.5-5. Consent to condemnation - Real property requirements. The state gives its consent, as required pursuant to § 42-64-9(a), to the condemnation by the EDC of any interest in any parcels of land within the Project Site which are owned by the state or any state agency, subject, in the case of parcels under the control of the department of transportation, to: (1) approval by the department to protect the integrity of highways or other related structures and the public safety relating thereto, and (2) receipt by the department of the value of any interest so condemned.
