A. Any report of contagious or infectious animal diseases obtained pursuant to the requirements of Section 698.15 of Title 59 of the Oklahoma Statutes and rules promulgated by the State Board of Agriculture shall not be required to be produced pursuant to the Oklahoma Open Records Act except in such a way that no person or farm can be individually identified, unless otherwise provided for by law. Specific information shall not be released except under the following circumstances:
1. Release is made upon court order;
2. Release is made in writing, by or with the written consent of the person whose information is being kept confidential;
3. Release is necessary as determined by the State Veterinarian to protect the health and well-being of the general public or domestic animals;
4. Release is made of medical or epidemiological information to health or veterinary professionals, appropriate state agencies or appropriate courts to enforce the provisions of this title and related rules concerning the control and treatment of animal diseases; or
5. Release is made of specific medical or epidemiological information for statistical purposes whether within the State of Oklahoma or throughout the United States, in such a way that no person or farm can be identified.
B. Nothing in this section shall be construed to limit the ability of the State Veterinarian or the State Board of Agriculture from utilizing reported information to the extent deemed necessary and for enforcing any provisions of Title 2 of the Oklahoma Statutes.
