136-44.6. Uniformly applicable formula for the allocation of funds for primary and secondary road maintenance.
The Department of Transportation, in consultation with its Division Engineers, shall develop a uniformly applicable formula for the allocation of funds from the Reserve for General Maintenance in the Highway Fund for maintenance on primary and secondary roads in each Highway Division. The formula shall take into consideration the number of paved and unpaved miles of state-maintained secondary roads in each Highway Division and such other factors as experience may dictate. Each Division Engineer shall have discretion in using funds allocated under this section to his or her Highway Division for maintenance activities. This section shall not apply to projects to pave unpaved roads under G.S. 136-44.2D.
