Section 3-4-3 - Disincorporation; conduct of election.

The election for disincorporation shall be conducted pursuant to the provisions of the Local Election Act [Chapter 1, Article 22 NMSA 1978].

History: 1953 Comp., § 14-4-3, enacted by Laws 1965, ch. 300; 1985, ch. 208, § 7; 2018, ch. 79, § 49.

The 2018 amendment, effective July 1, 2018, provided that a special election on the question of disincorporating a municipality shall be conducted pursuant to the provisions of the Local Election Act, and made technical and conforming changes; and after "the election", added "for disincorporation", after "shall be conducted", deleted "in the same manner as a special municipal election except that the election officials shall be appointed by the board of county commissioners, and the county clerk shall perform the duties of the municipal clerk and the board of county commissioners shall perform the duties of the governing body. The election returns shall be made to the board of county commissioners and canvassed in the same manner as are special election returns" and added "pursuant to the provisions of the Local Election Act".
