Any person:
1. Engaged in the manufacture, packing, canning, bottling or selling of any substance in containers with the name or other mark or device of the person impressed or produced thereon; or
2. Whose equipment or supplies, owned by the person and used in the business of the person, is marked or branded with a name or other mark or device impressed or produced thereon,
may file in the office of the county clerk of any county of this State and also in the Office of the Commissioner of Food and Drugs, a description of the name, mark or device so used; and may also cause such description to be published once a week for 3 successive weeks in a newspaper published in the county in which the description may have been filed.
