The board of supervisors may construct public roads along the side of and on the right of way of drainage canals or on any levees of any drainage districts of their respective counties, and for this purpose may use the dumps of earth taken from any canal or ditch, either as a road bed or otherwise, provided that no such road shall be constructed without the consent of the commissioners of the drainage district affected, and paying all damages to landowner.
