§160.8. The Louisiana Access to Better Care Medicaid Insurance Demonstration Project Oversight Board

A.(1) There is hereby created within the Louisiana Department of Health the Louisiana Access to Better Care Medicaid Insurance Demonstration Project Oversight Board, which shall consist of fourteen members.

(2) The three ex officio members shall include the following persons:

(a) The secretary of the Louisiana Department of Health or his designee.

(b) The commissioner of administration or his designee.

(c) The commissioner of insurance or his designee.

(3) The eleven remaining members of the board shall be appointed by the governor, to serve at his pleasure, upon the recommendation of each institution or organization represented:

(a) A representative from the health care services division of Louisiana State University Health Sciences Center.

(b) A representative from Tulane University School of Medicine.

(c) A representative from the Louisiana State University School of Medicine, New Orleans.

(d) A representative from the Louisiana State University School of Medicine, Shreveport.

(e) A representative from the Louisiana State Medical Society.

(f) A representative from the Louisiana Dental Association.

(g) A representative from the Louisiana Hospital Association.

(h) A representative from the Louisiana Pharmacists Association.

(i) A representative from the Louisiana Managed Healthcare Association.

(j) A representative from the Louisiana Health Care Commission.

(k) A representative from the Chiropractic Association of Louisiana.

(4) Each appointment by the governor shall be subject to Senate confirmation.

B.(1) The board shall act as an advisory body to the project and the department regarding the implementation of this Subpart. The board is authorized to make recommendations regarding the management, administration, and operation of the project.

(2) The board shall elect from among its members a chairman, a vice chairman, and a secretary. Any member may hold two of these positions. In the absence of the chairman, the vice chairman shall preside and in the absence of the chairman and vice chairman, the secretary shall preside.

(3) The members shall not receive compensation for their services but shall be entitled to reimbursement for expenses, including travel expenses, incurred in the discharge of their duties.

(4) Seven members shall constitute a quorum for the transaction of business.

(5) The secretary shall keep complete and accurate records of all meetings and actions taken by the board.

(6) The department shall provide administrative and technical assistance to the board.

(7) Meetings of the board shall be held at regular intervals as provided in bylaws adopted by the board. Emergency meetings may be held upon twenty-four hours notice, and business transacted at such meetings, provided that not less than a majority of all board members concur in the proposed action.
