309.402 Definitions for KRS 309.400 to 309.422. As used in KRS 309.400 to 309.422, unless the context requires otherwise: (1) (2) "Applicant" means a person who applies to the board for licensure as a home medical equipment and services provider; "Board" means the Kentucky Board of Durable Medical Equipment Suppliers established in KRS 309.404; (3) "Home medical equipment" means durable medical equipment which: (a) Withstands repeated use; (b) (c) (d) Is primarily and customarily used to serve a medical purpose; Is generally not useful to a person in the absence of illness or injury; and Is appropriate for use in the home; (4) (5) "Providing home medical equipment and services" means the sale, lease, rental, delivery, installation, maintenance, replacement, or instruction in the use of home medical equipment, related equipment and supplies, and mobility enhancing equipment used by a sick or disabled person to allow the person to be maintained in his or her residence and which is funded through a third-party payor; "Home medical equipment and services provider" or "provider" means a person engaged in the business of providing home medical equipment and services, either directly or through a contractual arrangement, to an unrelated sick or disabled person in the residence of that person; and (6) "Person" has the same meaning as in KRS 446.010.
