224.70-120 Permit to discharge pollutants into waters -- Fees

(1) As used in this section, "cabinet" shall mean the Energy and Environment Cabinet

(2) An applicant for a permit to discharge pollutants into waters of the Commonwealth shall be subject to a permit fee by the cabinet

(3) The permit fee shall be equal to the cost of review but shall not exceed the following amounts: (a) Major industry: three thousand two hundred dollars ($3,200); (b) Minor industry: two thousand one hundred dollars ($2,100); (c) Nonprocess industry: one thousand dollars ($1,000); (d) Large, non-publicly-owned treatment works: one thousand seven hundred dollars ($1,700); Intermediate, non-publicly-owned treatment works: one thousand five hundred dollars ($1,500); Small, ($1,000); non-publicly-owned treatment one thousand dollars works: (e) (f) (g) Agriculture: one thousand two hundred dollars ($1,200); and (h) Surface mining operation: one thousand two hundred dollars ($1,200)

(4) The cabinet may impose the maximum permit fee if a discharge falls into multiple categories
