76-4,115. Conveyance of certain real estate in Riley county by board of regents authorized; procedure. (a) The state board of regents is hereby authorized and empowered, for and on behalf of Kansas state university to sell and convey all of the rights, title and interest subject to all easements and appurtenances in the following described real estate located in Riley county, Kansas: A tract of land in the Southwest Quarter of Section 35, Township 9 South, Range 7 East of the 6th P.M., described as follows: BEGINNING at the Northeast corner of said Quarter Section, the East line having an assumed bearing of North 00 degrees 18 minutes East; FIRST COURSE, thence South 89 degrees 20 minutes West, 163.7 feet along the North line of said Quarter Section; SECOND COURSE: thence South 00 degrees 11 minutes East, 1869.4 feet; THIRD COURSE: thence South 16 degrees 56 minutes East to a point on the said East line, 300 feet North of the Southeast corner of said Quarter Section; FOURTH COURSE: thence North 00 degrees 18 minutes East along said East line to the place of beginning. The above contains 7.51 acres (7.49 acres Measured), more or less, exclusive of the existing highway.

(b) Conveyance of such rights, title and interest in such real estate shall be executed in the name of the state board of regents by its chairperson and executive officer. All proceeds from the sale and conveyance thereof shall be deposited in the Marlatt memorial park restricted use account of Kansas state university to be used for maintenance of such park.

(c) No conveyance of real estate authorized by this section shall be made or accepted by the state board of regents until the deeds, titles and conveyances have been reviewed and approved by the attorney general. In the event that the state board of regents determines that the legal description of the real estate described in this section is incorrect, the state board of regents may convey the property utilizing the correct legal description but the deed conveying the property shall be subject to the approval of the attorney general. The conveyance authorized by this section shall not be subject to the provisions of K.S.A. 75-3043a, and amendments thereto, or K.S.A. 2018 Supp. 75-6609, and amendments thereto.
