36-8-10-12.6. Credit for service earned before establishment of department retirement plan

Sec. 12.6. (a) This section applies to eligible employees of the departments of:

(1) Warren County, retirement plan effective January 1, 2008;

(2) Pike County, retirement plan effective January 1, 2010; and

(3) Perry County, retirement plan effective January 1, 2018;

who were employed by the respective department on the specified effective date of a retirement plan established under this chapter.

(b) An eligible employee to whom this section applies is granted service credit in the applicable retirement plan as of the effective date of the retirement plan for the eligible employee's service with the department before the effective date of the retirement plan to the extent that the eligible employee accrued service credit in the public employees' retirement fund for the eligible employee's service with the department as an eligible employee before the effective date of the retirement plan.

(c) If an eligible employee to whom this section applies accrued service credit with the public employees' retirement fund before the effective date of the retirement plan, the service credit in the public employees' retirement fund is waived as of the effective date of the retirement plan to the extent that the eligible employee accrued the service credit in the public employees' retirement fund for the eligible employee's service with the department as an eligible employee before the effective date of the retirement plan.

(d) IC 5-10.3-6-8, IC 5-10.3-6-8.2, IC 5-10.3-6-8.3 and any related provisions pertaining to withdrawing from or freezing of participation in the public employees' retirement fund do not apply to those eligible employees to whom this section applies.
