(105 ILCS 5/1-1) (from Ch. 122, par. 1-1) Sec. 1-1. Short title. This Act may be cited as the School Code. (Source: P.A. 86-1475.)
(105 ILCS 5/1-2) (from Ch. 122, par. 1-2) Sec. 1-2. Construction. The provisions of this Act, so far as they are the same as those of any prior statute, shall be construed as a continuation of such prior provisions, and not as a new enactment. If in any other statute reference is made to an Act of the General Assembly, or a section of such an Act, which is continued in this School Code, such reference shall be held to refer to the Act or section thereof so continued in this Code. (105 ILCS 5/1-3) (from Ch. 122, par. 1-3) Sec. 1-3. Definitions. The terms "common schools", "free schools" and "public schools" are used interchangeably to apply to any school operated by authority of this Act. "School board" means the governing body of any district created or operating under authority of this Act, including board of school directors and board of education. When the context so indicates it also means the governing body of any non-high school district and of any special charter district, including board of school inspectors. "Special charter district" means any city, township or district organized into a school district, under a special Act or charter of the General Assembly or in which schools are now managed and operating within such unit in whole or in part under the terms of such special Act or charter. (105 ILCS 5/1-3.5) Sec. 1-3.5. Use of term "registered mail". Whenever the term "registered mail" is used in this Code, it shall be deemed to authorize the use of either registered mail or certified mail, return receipt requested. (Source: P.A. 95-790, eff. 8-8-08.)
(105 ILCS 5/1-4) (from Ch. 122, par. 1-4) Sec. 1-4. It is the policy of this State that all powers granted, either expressly or by necessary implication, by this Act, other Illinois statute, or the Illinois Constitution to any public school district may be exercised by those public school districts notwithstanding effects on competition. It is the intention of the General Assembly that the "State action exemption" to the application of federal antitrust statutes be fully available to all public school districts to the extent their activities are authorized by law as stated herein.
