Judicial Client Services Fund § 9601. Fund Sources. § 9602. Separation of Accounts. § 9603. Reporting Requirements. § 9604. Legislative Appropriations. § 9605. Line of Credit Authorized. § 9600. Judicial Client Services Fund. There is hereby created a Judicial Client Services Fund for the Courts of Guam. All money collected for the Fund shall be deposited in interest- earning bank accounts as provided in § 9602 and § 9604 of this Chapter. § 9601. Fund Sources. All increase in fees, fines or revenues approved by the Supreme Court of Guam or the Judicial Council and collected by the Courts of Guam, which are over and above the fee schedules in existence as of September 12, 2002, for the filing of documents, or imposition of fines, except as otherwise mandated by 7 GCA Chapter 9, Article 2 and 8 GCA Chapter 161, relative to the Guam Law Library and the Criminal Injuries Compensation, respectively, shall be deposited into the Judicial Client Services Fund. 2016 NOTE: P.L. 27-138:4 (Dec. 30, 2004) amended and moved 9 GCA Chapter 86 (Criminal Injuries Compensation) to 8 GCA Chapter 161, and the reference were changed to correspond to the new citation. Reference to the “Territorial Law Library” changed to “Guam Law Library” pursuant to 1 GCA § 420 (added by P.L. 24-089 (Oct. 7, 1997)). § 9602. Separation of Accounts. The Superior Court of Guam shall establish an account or accounts for the Judicial Client Services Fund, separate and apart from that of the government of Guam General Fund accounts, the Judicial Building Fund, and the existing accounts of the Superior Court. The new account or accounts established for the Fund together with the interest earned thereon shall be for the following activities: 1 COL222017 7 GCA CIVIL PROCEDURE CH. 9.6 JUDICIAL CLIENT SERVICES FUND (a) Appointment of Counsel of Indigent Defendants including, but not limited to, attorney fees, investigator fees, interpreter fees, expert fees, jury fees, and any other related expenses approved by the Superior Court of Guam or the Supreme Court of Guam; (b) Law Enforcement Escort Costs; (c) Operations of Erica’s House; and (d) Language Assistance Services. SOURCE: Added by P.L. 27-055:2 (Dec. 17, 2003) and amended by P.L. 33-100:2 (Dec. 1, 2015). § 9603. Reporting Requirements. The Judicial Client Services Fund shall be under the stewardship of the Judicial Council. The Judicial Council shall prepare, or cause to be prepared, full statements of accounts of all money received and expended out of the account or accounts of the Judicial Client Services Fund, and shall transmit such report to I Liheslatura each fiscal year, together with the Budget Request of the Superior Court for the ensuing fiscal year. § 9604. Legislative Appropriations. I Liheslatura may, from time to time, appropriate funds from the General Fund for deposit in the Judicial Client Services Fund. Such funds, when appropriated, shall be paid directly to the Judicial Client Services Fund. § 9605. Line of Credit Authorized. The Judicial Client Services Fund may be encumbered as collateral for a line of credit to pay for court appointed attorney fees and any other expense approved by the Judicial Council of Guam or the Supreme Court of Guam, which may be entered into by the Superior Court of Guam, through its Judicial Council, and a lending institution chosen under its procurement regulations. ---------- 2 COL222017
