§ 10101. Legislative Agencies Fund: Creation

There is created a special fund of the government of Guam to be known as ALegislative Agencies Fund,@ which fund shall be kept separate and apart from the Legislature Operations Fund and separate books and accounts kept with respect to the Legislative Agencies Fund

§ 10102. Same: Purpose

The purpose of the Legislative Agencies Fund is to provide a fund for the operation of the independent agency of the Legislative Branch, namely, the Suruhanu. All appropriations made to the independent agency of the Legislature and all other funds received by each of them shall be placed into the Legislative Agencies Fund. All expenditures, for whatever purpose, made by the independent agencies of the Legislature shall be taken from the Legislative Agencies Fund

NOTE: The Office of the Territorial Auditor has been abolished pursuant to P.L. 17-7 and the Office of Compiler of Laws has been transferred from the Legislative Branch to the Executive Branch pursuant to P.L. 17-6

§ 10103. Separate Accounts for Each Agency

Within the Legislative Agencies Fund, separate accounts and books shall be kept for each agency utilizing the fund. The sums appropriated to each agency using the fund shall not be used by any other independent agency, provided, however, that the Committee on Rules, by majority vote of its full membership, may authorize the transfer of funds from the Legislative Agencies Fund to the Legislature Operations Fund

(a) The Disbursing Officer for each agency using the fund shall be the Disbursing Officer of the Legislature and the Certifying Officer for each agency using the fund shall be appointed by the Suruhanu, and the Certifying Officer, shall be responsible for keeping the books of the Legisla- tive Agencies Fund

(b) The authority to encumber and to authorize the expenditure of funds shall remain with each agency participating in the fund pursuant to the law creating such agency

§ 10105. Audit of Legislative Agencies Fund

The Legislative Agencies Fund shall be audited periodically at the same time and in the same manner as the Legislative Operations Fund is audited

§ 10106. Separate or Joint Bank Accounts

The Committee on Rules of the Legislature may, in its discretion, provide that the funds in the Legislative Agencies Fund be placed in a sepa- rate bank account or accounts or be placed in the same account as is the Legislative Operations Fund or be placed partially in one (1) account and partially in another account

§ 10107. Quarterly Transfer of Funds

Notwithstanding any provision of law to the contrary, thirty (30) days prior to the end of a calendar quarter, one-fourth (1/4) of the annual appropriation of the Legislative Agencies Fund shall be transferred from the General Fund to the Legislative Agencies Fund
