Certificate of Identification: Requirement and Fee. (a) Any person may obtain a certificate of identification from the Department of Revenue and Taxation. The Director of Revenue and Taxation is authorized to issue such certificate of identification without charge in a form prescribed by him. (b) Every applicant for a certificate of identification from the Department of Revenue and Taxation who is a veteran, pursuant to § 7120.2(b) of Chapter 7, Title 16, Guam Code Annotated, shall, at the applicant’s request, have the word ‘Veteran’ affixed on a section of the certificate of identification. The requirements of this Section shall also apply to the renewal of the same. SOURCE: GC § 8600. Amended by P.L. 33-190:2 (Sept. 26, 2016). § 57101. Same: Use. The certificate of identification provided for in § 57100 may be used for purposes of identification and admitted in evidence. SOURCE: GC § 8601. § 57102. Requirement of Guam Identification Card. Any non-United States citizen applying for any service of the government of Guam must possess and present a Guam Identification Card as a condition of eligibility. SOURCE: GC § 8602. Repealed and reenacted by P.L. 29-113:VI:55 (Sept. 30, 2008). § 57103. Certificates of Identification Issued to Minors. COL11/8/2019  All certificates of identification issued to persons under the age of eighteen (18) years of age shall prominently display the month and year in which such person will turn eighteen (18) years of age. SOURCE: Added by P.L. 24-169:3. § 57104. Guam Identification Card Issued to Organ Donors. All applicants to Guam Identification Card shall indicate whether he or she wishes and consents to be an organ donor under the Uniform Anatomical Gift Act and shall be a part of the application form. For those under eighteen (18) years of age, a parental consent shall be required prior to organ donor procurement. For those Guam Identification Card issued to persons agreeing to organ donation shall have the words affix >Organ Donor= on the lower segment of the picture portion of the Guam Identification Card or other section of the card that the Chief of Police deems appropriate. A Guam Identification Card with the organ donor designation is only revocable by obtaining a new Guam Identification Card without the organ donor designation. SOURCE: Added by P.L. 24-249:3. § 57105. Guam Identification Card Fees. Beginning October 1, 2009, a portion of the fees collected from each applicant for the issuance of a new, or renewal of, a Guam Identification Card under the provisions of this Chapter shall be deposited in the Better Public Service Fund of the Department of Revenue and Taxation in an amount equal to the higher of one-third (1/3) of the amount of the fees collected from all applicants, or Ten Dollars ($10.00) per applicant. Hearing/Speech Impaired, Guam Identification Card Special Notation, Definitions. (a) As used in this Section, the following terms mean: (1) Deaf person means any person who, because of hearing loss, is not able to discriminate speech when spoken in a normal conversation tone, regardless of the use of amplification devices; COL11/8/2019  (2) Hearing-impaired person means any person who, because of hearing loss, has a diminished capacity to discriminate a normal conversational tone; speech when spoken in (3) Speech-impaired person means any person who, because of hearing loss, or physical or emotional disability, has a diminished capacity to speak; (4) HSD is a notation on a Guam Identification Card, meaning “hearing or speech disability,” that indicates the person is a deaf, hearing-impaired or speech-impaired person who uses alternative communication. (b) Any resident of Guam who is a deaf, hearing-impaired or speech-impaired person may apply to the agency issuing Guam Identification Cards to have the notation “HSD” placed on the person’s Guam Identification Card. The agency issuing Guam Identification Cards shall establish the criteria for placement of the “HSD” notation, such as requiring an applicant to submit certain medical proof of deafness, hearing or speech impairment. Guam Identification Card for Homeless Individuals and Unaccompanied Homeless Youth. to apply The Department of Revenue and Taxation shall establish an exceptions process for a person who is homeless or is an unaccompanied homeless youth for a Guam Identification Card and to waive any fees associated with obtaining the identification card; provided further, that said process shall allow for a person who is homeless or is an unaccompanied homeless youth to submit proof of residency by providing documentation satisfactory to the Department of Revenue and Taxation from a homeless, social service, or other public assistance provider on Guam. For the purposes of this Section, the term homeless, shall mean a person as defined by the Stewart B. McKinney Homeless Assistance Act of 1987, § 103(a), 42 U.S.C. § 11302(a), as amended from time to time, and the term unaccompanied homeless youth, shall mean a person twenty-four (24) years of age or younger who is not in the COL11/8/2019  physical custody or care of a parent or legal guardian and who lacks a fixed, regular, and adequate nighttime residence.
