Section 5-248k - Paid leave for organ donation.

(a) As used in this section:

(1) “State employee” means any employee in the executive, judicial or legislative branch of state government, whether in the classified or unclassified service and whether full or part-time;

(2) “Paid leave” includes, but is not limited to, compensatory time, vacation time, personal days off or other paid time off; and

(3) “Organ” means all or part of a human liver, pancreas, kidney, intestine or lung.

(b) In addition to any medical leave from employment authorized under section 5-248a, any state employee who, on or after January 1, 2018, (1) donates an organ to a person for organ transplantation shall be entitled to up to fifteen days of paid leave from state employment as a recovery period from such donation, or (2) donates bone marrow to a person for transplantation shall be entitled to up to seven days of paid leave from state employment as a recovery period from such donation. Leave taken under this section shall not result in a reduction in pay, the loss of any leave to which the employee is otherwise entitled or a loss of credit for time or service or affect the employee’s rights with respect to any other employee benefits provided under federal or state law.

(c) Any state employee who takes paid leave under this section shall provide his or her employer with not less than seven days’ notice prior to the commencement of such leave when practicable.

(d) The employer may require verification from a physician licensed pursuant to chapter 370 of the purpose and length of the leave requested by a state employee under this section.
