Proof of mailing by certified mail, return receipt requested, notice of cancellation, or of intention not to renew or of reasons for cancellation, to the named insured, and any third party designated pursuant to section 38a-323a, at the address shown in the policy, shall be sufficient proof of notice.

*Note: On and after October 1, 2019, this section, as amended by section 15 of public act 18-158, is amended to read as follows:

“Sec. 38a-344. (Formerly Sec. 38-175j). Proof of notice. Proof of mailing by certified mail, return receipt requested, or, if agreed between an insurer and a named insured, delivery by electronic means with proof of a delivery receipt, notice of cancellation, an intention not to renew or of reasons for cancellation, to the named insured and any third party designated pursuant to section 38a-323a at the address shown in the policy, or by electronic means if agreed between an insurer and a named insured, shall be sufficient proof of notice.”

History: Sec. 38-175j transferred to Sec. 38a-344 in 1991; P.A. 02-60 added reference to “any third party designated pursuant to section 38a-323a”; P.A. 18-158 added provisions re notice by electronic means and proof of delivery by electronic means, effective October 1, 2019.
