(a) No person shall establish, operate, or maintain a junkyard containing any items listed in Section 45–44–170.01, but not limited to those items any portion of which is within 1,000 feet of the nearest edge of the right-of-way of any highway, without obtaining a county license to do so from the Macon County Commission through the county license commissioner, or other like official. No license shall be granted except for those junkyards, which are screened, by natural objects, plantings, fences, or other appropriate means so as not to be visible from the highway or any adjoining real property.
(b) Fencing shall mean a commercial privacy type fence and entrance gate such as of chain link with interwoven slats, also known as panelweaves, brick, wood, or a living fence comprised of plant material, erected so as to provide complete screening of the view to the passing public.
(c) The fence or wall shall not be less than eight feet nor more than 10 feet in height. In order for the area to remain hidden from the road-view, the planting of trees may be required. Any living fencing shall be maintained, pruned, and groomed at all times. Any other type fencing shall be maintained and kept in good order both structurally and esthetically at all times.
(d) All vehicle wrecking, salvage, junk, storage yards, and auto repair shops shall be required to be enclosed by a fence as described in this section. The gates shall be constructed in the same manner as the fence and shall be closed when not in use. There shall be no storage outside of the fence, and the fence shall be no closer than 20 feet from the right-of-way of the nearest roadway.
