A respondent may request the Suspending and Debarring Official to review a decision under this part as follows:
Within 30 days of receiving the decision, the respondent may ask the Suspending and Debarring Official to reconsider the decision based on clear and material error(s) of fact or conclusion(s) of law that would change the outcome of the matter. The respondent bears the burden of demonstrating the existence of the asserted clear and material error(s) of fact or conclusion(s) of law.
The respondent's request for reconsideration must be submitted in writing to the Suspending and Debarring Official and include:
The specific finding(s) of fact and conclusion(s) of law the respondent believes are in error; and
The reasons or legal bases for the respondent's position.
The Suspending and Debarring Official may in the exercise of discretion stay the debarment pending reconsideration. The Suspending and Debarring Official will review the request for reconsideration and:
Notify the respondent in writing whether the Suspending and Debarring Official will reconsider the decision; and
If reconsideration occurs, notify the respondent in writing of the results of the reconsideration.
